In no event will LifePlans’ liability to you pursuant to your use of the, site or the products or services provided as part of the site exceed the lesser of one hundred dollars ($100.00) or the amount you paid to access and use the products or the site.

This site is not intended for use by children under eighteen (18) years of age. By using this site, you represent that you are not under eighteen (18) years of age.

JURISDICTION

This site is controlled and operated by LifePlans from its offices within the State of Minnesota, United States of America. LifePlans makes no representation that Materials in the site are appropriate or available for use in other locations. These Terms of Use shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflicts of law principles. LifePlans' performance of these Terms of Use is subject to existing laws and legal process, and nothing contained in these Terms of Use shall derogate LifePlans' right to comply with law enforcement requests or requirements relating to your use of this site or information provided to or gathered by LifePlans with respect to such use. If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions. These Terms of Use constitute the entire agreement between the parties relating to the subject matter herein, and replace all prior or contemporaneous communications, oral or written.

BINDING ARBITRATION

You agree that any dispute arising out of or relating in any way to your use of this site requires that such claim be resolved exclusively by confidential binding arbitration except that, to the extent you have in any manner violated or threatened to violate LifePlans’ intellectual property rights, LifePlans may seek injunctive or other appropriate relief. The arbitration shall be conducted before one neutral arbitrator in Minneapolis, Minnesota, United States, in accordance with the rules of the American Arbitration Association (“AAA”), as then in effect. No claims of any other parties may be joined or otherwise combined in the arbitration proceeding. Unless otherwise expressly required by applicable law, each party shall bear its own attorneys’ fees without regard to which party is deemed the prevailing party in the arbitration proceeding. Except for punitive and consequential damages (which may not be awarded), and subject to these Terms of Use, the arbitrator shall be authorized to award either party any provisional or equitable remedy permitted by applicable law.

BECAUSE THE USE OF THIS SITE REQUIRES THE ARBITRATION OF ANY CLAIMS OR DISPUTES EXISTING BETWEEN THE PARTIES, NEITHER PARTY WILL HAVE THE RIGHT TO PURSUE THAT CLAIM IN COURT OR BEFORE A JUDGE OR JURY OR TO PARTICIPATE IN A CLASS ACTION OR ANY OTHER COLLECTIVE OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. OTHER RIGHTS THAT EITHER PARTY WOULD HAVE IF SUCH PARTY WENT TO COURT, INCLUDING WITHOUT LIMITATION THE RIGHT TO CONDUCT DISCOVERY OR TO APPEAL, MAY BE LIMITED OR UNAVAILABLE IN ARBITRATION.
